Article 1: Fields of application and modification of the general conditions of sale
These general conditions of sale and rental apply to all orders placed on the sales sites of Ecosapin sàrl.

Article 2: Product availability

Article 4: Price
Ecosapin sàrl reserves the right to modify its prices at any time, but undertakes to apply the prices displayed at the time of your order. The prices indicated are expressed in Swiss francs and include all taxes (delivery, administrative costs, VAT). In the event of non-compliance with the recovery procedure Ecosapin sàrl reserves the right to invoice the following recovery (s). Article 5: Terms of payment and security
You can pay by bank or postcard, or by invoice.
Payment is made as desired on the secure banking or postal servers of our partners. This implies that no banking or postal information concerning you passes through our sites. Payment by bank or postcard is therefore perfectly secure. Your order will be recorded and validated upon acceptance of payment by the bank or the Post office depending on your choice. Your order will be validated and your card automatically debited when you register your order. You must complete the registration form offered on the site, before you can place an order.
In the case of invoicing by BV, payment must be made within 30 days. In the event of non-compliance with this close Ecosapin sàrl reserves the right to charge additional costs.
Article 6: Terms of delivery and delivery times
The products are delivered to the delivery address you gave us during the ordering process. If at the time of delivery, the original packaging is damaged, torn, opened, you must then check the condition of the items. If they have been damaged, you must report the anomalies by email or registered mail at the latest within 3 working days of receipt (parcel refused because open or damaged).
Deliveries in the Canton of Vaud are made without packaging. A bag is provided.
Article 7: Responsibilities
Our partners cannot be held responsible for damage to products offered by Ecosapin sàrl within the framework of the laws in force. Ecosapin sàrl cannot be held responsible for non-performance of the contract or damage caused by exceptional events: for example floods or fires. Regarding products purchased to meet professional needs, Ecosapin sàrl will not incur any liability for any indirect damage as a result of these (operating loss, loss of profit, loss of data, loss of contract, damage or any other costs that may arise).
Ecosapin sàrl only responds to direct damage that the customer can prove and which are causal with a serious fault of the company or a third party mandated. Liability is limited to the price of the product delivered or the service provided. The choice and the purchase of a product or a service are placed under the sole responsibility of the customer. In the event of non-delivery of an order, you have a maximum of one week (from the delivery date entered when you placed your order) to come forward. Beyond this period, we will not accept any complaints.
Article 8: Obligations of the buyer

Article 11: Applicable law and place of jurisdiction
This contract, as well as the sales and rentals organized by Ecosapin sàrl, are governed by Swiss law. In the event of a dispute, the place of jurisdiction is Lausanne.
Article 12: Original text
The general conditions of Ecosapin sàrl are written in French and German. In case of contradiction, the French version is authentic.
Article 13: Special condition for rental
The tree, the cultivation pot, the flowerpot, the saucer and the tree bag are the entire property of Ecosapin sàrl. They must be returned in their sent condition. It is forbidden to cut branches or the tip of the fir tree, which would hinder its growth. It is forbidden to spray paint, lacquer, dyes or any other chemicals on the tree. If one or more of these items is not returned, Ecosapin sàrl has the right to claim them from the customer. Once the order has been placed, you have a period of up to 10 days before delivery to modify or cancel your order once this period has passed, the tree will arrive at your home and we will not accept any complaint, the whole of the price of the order will be charged.
On the day of the recovery, the tree and all its accessories (the culture pot, the flowerpot, the saucer) must be put back in the tree bag and placed in front of the door (for the building doors in front of the building door if it is locked). All items rented by Ecosapin Sàrl must be returned in a condition resulting from use in accordance with the contract and these general conditions. Any damage caused to these items may be billed to the customer.
When the delivery person passes by, if the bag cannot be found, Ecosapin Sàrl and the Swiss Post cannot be held responsible. If the Ecosapin does not suit you, a second pick @ home return must be ordered at the price of CHF 19 .--. It is not possible to change your tree for another. It is possible to order another tree while stocks last. Ecosapin sàrl will not accept any complaints about the quality of these trees (which are selected by specialists).
